So there is no evidence for those that say: "Why haven't you clarified these deviations before?!"

The Fadeelatus-Shaykh:
Abu Hatim Yusuf Al-Jazaa'iree, may Allah preserve him and protect him, wrote:

❝And from the things which I will mention in this occasion:

That when Dr.Rabee Al-Madkhali put out some his writings on the subject matters of Eemaan, and whoever refuted him refuted him, and they were severe upon him in this, some of those we used to think well of phoned me, and requested from me -pressingly- to write in defence of Dr.Rabee Al Al-Makdhali, and to clarify his innocence from Irjaa, so I sought aid with Allah and compiled some of his articles so as to look into it, so that my defence can be built upon just and fairness, then it became clear to me (1) from his speech - after a minor examination - him being in opposition to the creed of the Salaf in this subject matter (2).

Then I clarified to those that requested from me that Dr.Rabee is guilty, and that what's obligatory upon him is to free himself and his creed by establishing the creed of the Salaf, and to leave the these deviations!

Then it was from the virtue of Allah the most high that He brought out from the people of knowledge - like Al-Fawzaan and Ar-Raajihi and the Mufti - who condemned some of what's in the articles of Dr.Rabee Al-Madkhali of oppositions to the Salafi creed in this subject matter, whereby they were asked regarding some of what it contained, so they clarified some of what it contained of deviation, and I saw this to be sufficient in clarification of the truth, and abstaining from the mistake, for those that are fair and and free from blind fanaticism.

But when the persistency of Dr.Rabee increased in the prevailing of the Irjaa creed, and authored much writings in refutation of the creed of the Salaf in this subject matter and this spread throughout the world, and many - who don't have any discern or insight - were affected by what's in his articles of false adornment and deception, so I sought aid with Allah in the writing of this study in aid of the Salafi Creed. And in manifestation of their evidences, and clarification of the blundering and contradiction of those that deviated from their way of the Khalaf.

And this is not to prevail myself, rather I wrote this while I'm saddened and in grief for the Dr.Rabee and others that tread upon his way.

And I'm not not defending those that he mentioned in his refutations, who are known by the readers, in this writing of mine.

1) And our studies of the subject matter of Emaan and taking the creed of the Madhab of the Salaf in this is not something which has come about recently, we - and all praise is to Allah - are upon the creed of Ahlussunnah in this subject matter and other than it, since the very beginning of setting out on seeking knowledge, and we have taken the correct creed in Darul-Hadith in Dammaj, for many of years, and Allah is the granter of success.
2) Even his early writings weren't free from Irjaa, but Dr.Rabee when he used to manifest aiding of the Sunnah, it used to be a covering for him, and Ahlussunnah used to think well of him and his writings, and we didn't come across those early writings, not that we'd left him to remain upon his falsehood in this regarding!

This is due to those that put themselves forward for Da'wah, and have books and tapes which could be obtained, if opposition to the Salafi creed and their Da'wah is known from their affair - as is the case with Dr.Rabee Al-Madkhali - then it becomes the case that his authorings and tapes are thought to contain these establishments which contradict the Salafi Manhaj, so the searching and inspecting it for this, and clarifying it for the people so they may be warned, becomes from what's is Fard Kifaa'i (if some establish it, if suffices others from having to do it) upon those that have capability, especially if it's known that it has become widespread between the people, and their good thoughts of the callers to Allah, and that their mistakes are attributed to the religion ...
and those that upkeep this are thanked, and with the permission of Allah rewarded for what they put forth of defence of the religion, and for establishing what the lord of all that exists has obligated upon them, and taking the Imams of the believers as an example, as the Salafi Creed is more valuable than them and others, and the truth is greater than all that are great... So there is no evidence for those that say: "Why haven't you clarified these deviations before?!" And Allah is the granter of success❞.

Linguistically is:

"From being forced (الاضطرار) which the root word is (اضطر) force, whereby it is said : so and so forced him to this when he compelled him to this, when he did not have a choice, and the word dire necessity (الضرورة ) is used upon the severe need."

Answer:
There is no dire necessity, is the sword upon a persons neck!
Whereby he fears upon himself if he does not enter the university that he will be thrown into prison, or fears for his wealth, his honour, whereby there takes place that which he can not bare?"

"The one who is forced is:
He who fears upon himself destruction, or he fears that what he can not bare of loss of his self or his wealth or his honour, this is the one who is called the one who is forced, as for the expansion of this from those of this era in this affair, is an affair which is displeasing."

"The dire necessity which the legislation makes a critirium, and the people of knowledge say: that which takes place therein harm to a person which he can not bear, to himself or his wealth, some of the people expanded the principle of dire necessity, and made shaving of the beard and looking at satellite channels and wearing pants, likewise free mixing education, and bigoted groups and parties, and voting, a dire necessity! Rather it is from that which is prohibited and not a dire necessity."

بسم الله الرحمن الرحيم
 
 
All praise is for Allah, we praise Him, we seek His help, we ask for His forgiveness, and we seek refuge with Allah from the evils of our own souls and the wickedness of our actions, whoever Allah guides, there is none that can lead him astray, and whoever Allah allows to go astray, there is none that can lead him to the right path.
 
I testify and bear witness that there is no deity worthy of worship in truth but Allah, alone, without any partners.
 
And I testify and bear witness that Muhammed is His Slave and Messenger.
 
يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ ٱتَّقُوا۟ ٱللَّهَ حَقَّ تُقَاتِهِۦ وَلَا تَمُوتُنَّ إِلَّا وَأَنتُم مُّسْلِمُونَ
"O you who believe! Fear Allah (by doing all that He has ordered and by abstaining from all that He has forbidden) as He should be feared. [Obey Him, be thankful to Him, and remember Him always], and die not except as Muslims with complete submission to Allah."
[Aal-i-'Imraan:102]
 
يَٰٓأَيُّهَا ٱلنَّاسُ ٱتَّقُوا۟ رَبَّكُمُ ٱلَّذِى خَلَقَكُم مِّن نَّفْسٍ وَٰحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَآءً ۚ وَٱتَّقُوا۟ ٱللَّهَ ٱلَّذِى تَسَآءَلُونَ بِهِۦ وَٱلْأَرْحَامَ ۚ إِنَّ ٱللَّهَ كَانَ عَلَيْكُمْ رَقِيبًا
"O mankind! Be dutiful to your Lord, Who created you from a single person (Adam), and from him (Adam) He created his wife [Hawwa (Eve)], and from them both He created many men and women and fear Allah through Whom you demand your mutual (rights), and (do not cut the relations of) the wombs (kinship). Surely, Allah is Ever an All-Watcher over you."

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ ٱتَّقُوا۟ ٱللَّهَ وَقُولُوا۟ قَوْلًا سَدِيدًا   يُصْلِحْ لَكُمْ أَعْمَٰلَكُمْ وَيَغْفِرْ لَكُمْ ذُنُوبَكُمْ ۗ وَمَن يُطِعِ ٱللَّهَ وَرَسُولَهُۥ فَقَدْ فَازَ فَوْزًا عَظِيمًا
"O you who believe! Keep your duty to Allah and fear Him, and speak (always) the truth.
He will direct you to do righteous good deeds and will forgive you your sins. And whosoever obeys Allah and His Messenger (ﷺ) he has indeed achieved a great achievement (i.e. he will be saved from the Hell-fire and made to enter Paradise)."
[Al-Ahzaab:70-71]

Amma Ba'd:

A bundle of questions has reached me from brothers for the sake of Allah, students of knowledge whose requests are not rejected, they mentioned therein a number of questions regarding the ruling of those that are ignorant of Tawheed, and the establishment which is in agreement to the creed of the Salaf in this subject matter and its evidences, and the affairs that the opposer built their opposition upon, and they mentioned some establishments and some terms which they wished to be discoursed and discussed and a clarification of the extent of it agreeing with the evidences and the Manhaj of the Salaf.

So I responded to them in this - seeking aid with Allah - in clarifying what the evidences of the Book and the Sunnah and Consensus of the Salaf -who we are commanded to follow their understanding of the legislative texts and the legislation- point towards.

As stopping at this, is the path of the truth and the middle path, and the most high said:

(وَكَذَٰلِكَ جَعَلْنَٰكُمْ أُمَّةً وَسَطًا)
"And thus we have made you a [middle] just nation".
[Al-Baqarah:143]

◾️The most important subjects which are found in this knowledge-based discourse:

These papers contain a discourse on a number of points in this important subject matter, and with by clarifying it, it will become clear -with the permission of Allah-, from it is:

▪️A clarification that the differing in this subject -which hasn't got anyone from the righteous predecessors who stated it- is of a later kind, and it doesn't nullify the previous Consensus of the Salaf and the Imams, and a relaying the mention of a consensus by twenty one Imams.
▪️ An establishment that the excusing of the ignorant of Tawheed is present in the legislation -for those that are new to Islam or in a far away remote country, who didn't have the Da'wah of Tawheed reach them, without them been negligent or having turned away- but this is for the descending of the penalty in the worldly life and the punishment of the hereafter, not in the title and the outward ruling of Disbelief and Shirk, and on the day of judgement they will carry the ruling of the people of Al-Fatrah and they will tested on the day of judgement, as the evidences point towards this.

▪️A clarification that those who are ignorant of Tawheed, who live in the midst of the Muslims, are those that have turned away stubbornly, and them not being excused is an area of consensus and unanimous agreement.

▪️A clarification of the understanding of the Salaf and the Imams regarding the evidences in negating the punishment before clarification occurs, and that this doesn't contain a negation of labeling a Mushrik.

▪️A clarification on the importance of understanding the terminologies of the people of knowledge in this subject matter in the manner they clarified, and that their negation of making Takfeer of the ignorant of Tawheed is descended upon the inward disbelief which one is punished for, and not the outward Disbelief and the ruling of having made Shirk.

▪️The obligation of making a difference between the clear and apparent affairs, and there not being any excuse in this, and the obscured hidden affairs, and giving excuse for this.

▪️A clarification of the frailty of what the opposers use as evidences in this topic -to give the ignorant of Tawheed the ruling of Islam-: either in what relates to authenticity or what relates to how it's used as a proof, or both, like the Hadith of "Dhaatu Anwaat", or the Hadith of the man who requested his children to burn him after he died, and other than this.

▪️A clarification of the evidences and the consensus of the Salaf in the despicability of Shirk, and that applicability of the title Shirk on those that commit it, being affirmed in the Qur'an before the establishment of the evidences, but that the ruling upon them of being punished in the worldly life and the punishment of the hereafter, is dependent on the establishment of the evidence.

▪️That the differing of the Ash'aris; those that fell short and called the ignorant of Tawheed Muslims, and the Mu'tazilah; those that went out of bounds and declared upon them the disbelief which one is punished for without stipulating the establishment of the evidences, both of their positions are based upon the subject of ˹At-Tahseen˺ declaring to be good and ˹At-Taqbeeh (1), and clarifying the Manhaj of the Salaf in this.

(1) And we are not in any way directing in our speech -unlike some people have insinuated- to those from the Imams who have taken the position of the people of Al-Fatrah being punished -and they are opposed by the majority of the Salaf and they said that they will be tested due to the establishment of the proofs which are a clear textual matter in the area of dispute-, because my speech is descended upon the Mu'tazilah who built their position upon the subject of the rhetoric ˹At-Tahseen˺ and ˹At-Taqbeeh˺, whereby my statement: "and the Mu'tazilah" is tied to what's before it, meaning: "and the differing of the Mu'tazilah... is built upon the subject of ˹At-Tahseen˺".

A clarification of the meaning of the exception the people of knowledge make for those that are brought up and living in far away remote regions, or those new to Islam, when they give them an excuse.

Introduction

Indeed [from what is known from the religion by necessity is that the returning point in the affairs of the foundations of the religion is the Book and the Sunnah and the Consensus -the one which is taken into consideration- of the Ummah, which is what the companions were upon, and the returning point is not a particular scholar in this, whoever had this foundation become established with them in a manner which is not warded by doubt, and took it by the very fibres of their heart, whatever they may come across of confusing speech in some of the authorings of the Imams, will become insignificant, because none are infallible except the Prophet ﷺ.

And this topic of ours, which is the worship of Allah alone without any partners, and freeing oneself from the worship of anything besides Him, and that those that worship others alongside Allah, have performed major Shirk which expels from the religion: is the foundation of the foundations, and it is what Allah sent the Messengers with and revealed the Books, and it is what established the evidence upon the people by the Messenger and the Qur'an]. (1)

I have discoursed in these papers -as preceded- the subject of the excuse of those ignorant of Tawheed, and a number of subjects which were researched by the people of knowledge in this subject matter, I have embarked upon the verification of this based upon this foundation, intended therewith benefiting myself and my brothers the students of knowledge, by studying these subject matters which are of a great status due to its connection to Tawheed; which is the right of Allah upon the slaves.

And I'm not intending in this writing of mine a refutation of a specific person, it is only a verification by me on this subject matter in a summarised manner, which I haven't withheld -with the assist being from Allah- effort in clarifying the subject matter to my brothers that asked me, and those who what I have written may reach, so that they can be upon insight in this subject matter, embarking in this upon the statement of the most high:

(إِنْ أُرِيدُ إِلَّا ٱلْإِصْلَٰحَ مَا ٱسْتَطَعْتُۚ وَمَا تَوْفِيقِىٓ إِلَّا بِٱللَّهِۚ عَلَيْهِ تَوَكَّلْتُ وَإِلَيْهِ أُنِيبُ)

"I only intend reform as much as I am able. And my success is not but through Allah . Upon him I have relied, and to Him I return".

The legislative establishment of the excuse of ignorance:

Then know that the excuse of ignorance in the legislation, is an affair which is established with evidences from the book and the Sunnah, which came with the clarification of this basis, and clarified its point of connect and what it relates to.

Whereby [the ruling differs upon a person if they are excused in the affairs of the religion or not, in accordance to the evidences reaching them or not, and in accordance to the subject matter in and on itself in what relates to clarity and obscurity, and the different levels of the understanding of the people, the strength thereof and their weakness]. (1)

And all those that want to obtain the precision in the position in this subject, based upon the evidences of the Qur'an and the Sunnah upon the methodology of the Salaf, then upon them is to give attention to what the evidences point towards , and following what is found therein of meanings, until this brings about understanding of the intent of Allah and the intent of His Messenger ﷺ, using as the understanding of the Salaf and the Imams of the legislative texts as a guide in this, not turning left and right away from this.

But from the people are those who didn't give careful attention in the legislative texts and the speech of the Imams regarding the connection of the excuse of ignorance, and what it relates to, so they spoke on this topic, and fell short of what's correct.

And they didn't pinpoint the position in this based upon what the legislative texts point towards, nor understood the speech of the Imams in the manner that they intended in their establishments, and what they meant in their wording and terminologies, which then caused them mistakes in their understanding of their speech and their intent.

And many a time mistakes occur from many people, due to not paying attention to the terms of the Imams, and As-San'aani -may Allah have mercy upon him- clarified in "Tawdeehul-Ahkaam" (190/1) that those that don't pay attention to this, and don't know this, they will make mistakes upon the Imams, and by knowing their terms there won't be mistakes.

[And whoever doesn't practice the sciences, and are not the produce of those that carry knowledge and are people of understanding of what's come from Allah, they will make flail in the sciences due to their opinions, and it's not strange that those that these topics have become obscured upon them, and they haven't been granted guidance in their paths, which isn't known except by those that excercise this practice, and know what's found in this commodity]. The connection of the excuse of ignorance to the topic of names and rulings:

This topic is connected to a great and dangerous subject matter, which is the subject matter of Names and Rulings.

I.e the names in the religion:
Like the name Muslim and Mushrik, Disbelievers and Believer, Dhaalim, Faasiq, wrongdoer and the likes, and their rulings in the worldly life and in the hereafter, outwardly and inwardly.

And the Imams have clarified the principles of this subject matter and it's principles which are based upon the Book of Allah and the Sunnah of the Prophet ﷺ and the understanding of the Salaf, whoever was to speak in this subject matter based upon this correct understanding of this establishment, then you will find their speech precise, and not containing contradictions -with the permission of Allah- in accordance to their adhering and their performance in light of these foundations and legislative principles, in confirmation of the statement of the most high:

(وَإِنَّهُۥ لَكِتَٰبٌ عَزِيزٌ ۝ لَّا يَأْتِيهِ ٱلْبَٰطِلُ مِنۢ بَيْنِ يَدَيْهِ وَلَا مِنْ خَلْفِهِۦۖ تَنزِيلٌ مِّنْ حَكِيمٍ حَمِيدٍ)
"And indeed, it is a mighty Book".
Falsehood cannot approach it from before it or from behind it; [it is] a revelation from a [Lord who is] Wise and Praiseworthy".
[Fussilat:41-42]

(أَفَلَا يَتَدَبَّرُونَ ٱلْقُرْءَانَۚ وَلَوْ كَانَ مِنْ عِندِ غَيْرِ ٱللَّهِ لَوَجَدُوا۟ فِيهِ ٱخْتِلَٰفًا كَثِيرًا)
"Then do they not reflect upon the Qur'an? If it had been from [any] other than Allah, they would have found within it much contradiction".
[An-Nisa':82]

◾️The evidences of the Book and the Sunnah clarified that the title Mushrik, Jaahili, Dhaalim, liar, wrongdoer, and the likes of this of names which are blameworthy are names which are affirmed before the coming of the Message and the establishment of the evidence.

And the evidences have clarified that the labeling with Mushrik is only applicable at the perpetrator commuting the actions of the people of Shirk (1), and it is not dependent upon the establishment of the evidences, and it doesn't have a connection to the excuse of ignorance.

So the relation of the excuse of ignorance and the establishment of the evidences and putting them into effect and its stipulation is only at the application of the punishment upon those ignorant of Tawheed in the worldly life byway of the penalty of the people of Shirk and the likes, and the applicability of the punishment and the ruling of everlasting dwelling in the fire, so there is no application of the punishment in the worldly life nor stating with certainty that there is punishment in the hereafter except after the establishing of the evidences upon them, as further clarification on this will come -with the permission of Allah-.

And there is much of evidence for the establishment which has preceded. [to come on p.8 onwards⤵️]

1) [And it's well known by all those with intellect: that the realities of the affairs don't change due to the changing of their names, so if we called: Zinaa, Ribaa, Khamr with other than its names, then the changing of the name doesn't exit it from being: Zinaa, Ribaa, Khamr, and similarly the rest of this.

And it's known that Shirk, is only prohibited due to despicability of it, in and on itself, and due to it containing insulting of the Lord, and belittling Him, and resembling Him to the creation, so these harms don't go away by the changing of its name, like calling it: means, intercession, veneration of the righteous and respecting them, and the likes of this.

The Mushrik is a Mushrik, want it or not, like a fornicator is a fornicator, want it or not, and the Usurer is a usurer, want it or not]. Stated by the Allamaah Abdullah Aba Butayn, may Allah have mercy upon him, as it comes in <Majmuu' At-Tawheed> (p.171).

And [the Shaytaan was intricate in the plotting against those extreme, regarding the graves of the righteous, and he inserted in them the changing of the legislative names and terminologies, and the linguistic wordings, so they called Shirk and the worship of the righteous taking means and calling, and having good beliefs of the righteous, and taken them as intercession, and using their noble souls, then the childish of minds responded to them, and the lowly of insight, and revolves around these names and they didn't stand at the realities]. Stated by the Allaamah Abdul-Lateef bin Abdirrahman, may Allah have mercy upon him, in his letter to Uthman Al-Qhaadi as found in "Ad-Durar As-Saniyyah".

▪️The most high said:

(وَإِنْ أَحَدٌ مِّنَ ٱلْمُشْرِكِينَ ٱسْتَجَارَكَ فَأَجِرْهُ حَتَّىٰ يَسْمَعَ كَلَٰمَ ٱللَّهِ ثُمَّ أَبْلِغْهُ مَأْمَنَهُۥۚ ذَٰلِكَ بِأَنَّهُمْ قَوْمٌ لَّا يَعْلَمُونَ)
"And if any one of the Mushriks seeks your protection, then grant him protection so that he may hear the words of Allah . Then deliver him to his place of safety. That is because they are a people who do not know".
[At-Taubah:6]

Whereby Allah called them Mushriks, in His statement:

(وَإِنْ أَحَدٌ مِّنَ ٱلْمُشْرِكِينَ)
"And if any one of the Mushriks".
[At-Taubah:6]

And He affirmed for them being ignorant, as it comes in His statement:

(ذَٰلِكَ بِأَنَّهُمْ قَوْمٌ لَّا يَعْلَمُونَ)
"That is because they are a people who do not know".
[At-Taubah:6]

All of this before clarification and the conveying, as it comes in his statement:

(حَتَّىٰ يَسْمَعَ كَلَٰمَ ٱللَّهِ)
"So that he may hear the words of Allah . Then deliver him to his place of safety".
[At-Taubah:6]

▪️And He exalted is He said:

(لَمْ يَكُنِ ٱلَّذِينَ كَفَرُوا۟ مِنْ أَهْلِ ٱلْكِتَٰبِ وَٱلْمُشْرِكِينَ مُنفَكِّينَ حَتَّىٰ تَأْتِيَهُمُ ٱلْبَيِّنَةُ)
"Those who disbelieved among the People of the Scripture and the Mushriks (polytheists) were not going to leave (their disbelief) until there came to them clear evidence -"
[Al-Bayyinah:1]

Whereby Allah called them Mushriks before the coming of the evidence.

▪️As Allah the most high, in many verses called the people of the Messengers: Mushriks, Dhalimun, liars and other of this of titles, before the coming of the Messengers and the revealing of Books, but He the most high didn't descend upon them the worldly punishment and the punishment of the Hereafter, except after the establishing of the evidences upon them.

◾️And in the clarifying of this -with a clear clarification- Shaykh-Ul-Islaam Ibn Taymiyyah, may Allah have mercy upon him, said: ""The title of Mushrik is affirmed before the Message, because they make partners with their lord and make equals to Him, and they make other deities besides Him, and make rivals unto Him before the Messenger, and it is affirmed that these names precede it, similarly ignorance and pre-Islamic period of ignorance, it is said: Pre-Islamic ignorance, and ignorant before the coming of the Messenger, as for the punishment then no". <Majmuu' Al-Fataawa> (20/38)

Then he -may Allah have mercy upon him- mentioned legislative texts from the Qur'an which clarify this, as in the statement of the most high:

(ٱذْهَبْ إِلَىٰ فِرْعَوْنَ إِنَّهُۥ طَغَىٰ)
"Go to Pharaoh. Indeed, he has transgressed."
[Ta Ha:24]

And He said:

(وَإِذْ نَادَىٰ رَبُّكَ مُوسَىٰٓ أَنِ ٱئْتِ ٱلْقَوْمَ ٱلظَّٰلِمِينَ ۝ قَوْمَ فِرْعَوْنَۚ أَلَا يَتَّقُونَ)
"And [mention] when your Lord called Moses, [saying], "Go to the wrongdoing people -The people of Pharaoh. Will they not fear Allah?"
[Ash-Shu'ara':10-11]

And He said:

(إِنَّ فِرْعَوْنَ عَلَا فِى ٱلْأَرْضِ وَجَعَلَ أَهْلَهَا شِيَعًا يَسْتَضْعِفُ طَآئِفَةً مِّنْهُمْ يُذَبِّحُ أَبْنَآءَهُمْ وَيَسْتَحْىِۦ نِسَآءَهُمْۚ إِنَّهُۥ كَانَ مِنَ ٱلْمُفْسِدِينَ)
"Indeed, Pharaoh exalted himself in the land and made its people into factions, oppressing a sector among them, slaughtering their [newborn] sons and keeping their females alive. Indeed, he was of the corrupters.".
[Al-Qasas:4]

So He informed that he was a Dhaalim (an oppressor) and a transgressor, and a corrupter him and his people, and these are titles for blameworthy actions, and blame is only for bad despicable actions, which points to that actions were despicable and blameworthy before the coming of the Messengers to them, but they don't deserve punishment except after the coming of the Messengers to them, based upon His statement:

(وَمَا كُنَّا مُعَذِّبِينَ حَتَّىٰ نَبْعَثَ رَسُولًا)
"And never would We punish until We sent a messenger".
[Al-Isra':15]

And Allah the most high called the people of Hud:

(مُفْتَرُونَ)
"worship Allah ; you have no deity other than Him. You are not but inventors [of lies]".
[Hud:50]

Before He made a ruling which they opposed, the most high said:
(ٱعْبُدُوا۟ ٱللَّهَ مَا لَكُم مِّنْ إِلَٰهٍ غَيْرُهُۥٓۖ إِنْ أَنتُمْ إِلَّا مُفْتَرُونَ)
"worship Allah; you have no deity other than Him. You are not but inventors [of falsehood]".
[Hud:50]

Due to them taking other deities alongside Allah. Look in <Majmuu' Al-Fataawa> (20/37-38).

I say:
So it has become clear that there isn't any correlation between labeling the person who commits major Shirk as a Mushrik, and between the excuse of ignorance and the establishment of the evidences.

And from the establishment of the people of knowledge and their pinpointing of this, is:

▪️The statement of the "Standing committee of Iftaa" with Imam Ibn Baaz -may Allah have mercy upon him- as the president- regarding those that attribute to Islam and commit major Shirk: "They are considered disbelievers apostates from Islaam, Mushriks having made partners with other than Allah in worship,

But they could be excused due to ignorance so the punishment isn't applied to them until they are informed and the evidences are established upon them.

So clarification and establishment of the evidences is only for them to be excused before the punishment is applied to them, not to call them disbelievers after this clarification, because they are called disbelievers for what has occured from them of prostrating to other than Allah". End of speech, in a summarised fashion, the complete speech will come soon with the permission of Allah.

▪️The statement of the Allaamah Abdullateef bin Abdirrahman -may Allah have mercy upon him-  in <Manhaj At-Ta'sees wat-Taqdees> (p.316): "The lack of establishment of the evidences doesn't change the legislative names, rather they are called what the Legislator labelled them, in what relates to Disbelief or Shirk or Fisq, using its legislative name, and it is not negated from them, even if they are not punished for their action when they haven't had the evidences established upon them or the Da'wah didn't reach them". End of speech of what's intended in a summarised fashion.

▪️The statement of the Allaamah Al-Aalusi Abul-Ma'aali Mahmuud Shukri -may Allah have mercy upon him- who said in "Ghaaytul-Aamaani fir-Rad Alal-Nabahaani" (v.1 p.45): "Calling those that worship other than Allah Muslims, they are more in need to have their intelligence treated than having the evidences established upon them". End of speech.

▪️And the statement of the Allaamah Ibn Utheymeen -may Allah have mercy upon him-: "Calling this man who is vowing to the graves and Awliyaa and is invoking them, a Muslim is ignorance of what is being called, in reality is that he isn't a Muslim because he is a Mushrik". End of speech from "Fataawa Nuur Alad-Darb" (tape no.28).

And more clarification will come on this with the permission of Allah.

◾️The importance of reflecting over the essence of Tawheed and through what one obtains the title of Islam and Muslim:

The majority of those that fall short of being correct in the understanding of this subject matter, is due to lack of diligence regarding knowing the reality of Tawheed and its essence, as [those who picture the reality of whatever it may be, in the manner it's upon outwardly, and understood its essence through its specific qualities: they will certainly come to know what nullifies it and what opposes it, and obscurity only occurs due to mixing of one of its two realities, or ignorance regarding both essences.

And when this isn't present, and complete envision is obtained, then one of the two affairs doesn't become obscured nor does one become mixed with the other, how many are those from the Ummah that were destroyed due to shortcoming in knowledge and the lack of knowing the boundaries and the realities, and how plenty are those that fell due to this into mistakes and doubts and confusion, the likes of what we are now discussing, and it is:

▪️That Islam and Shirk are two contrasting opposites, they don't come together nor can both be absent (1), and that ignorance regarding the reality of the two, or one of the two, has caused many people to fall into Shirk, and the worship of the righteous, due to lack of knowing the realities and not picturing it (properly)]. (2)

And the fact that they are two contrasting opposites is from the following angle:
That it's a must that slave either is a worshippers of Allah or other than Him.

Shaykh-Ul-Islaam, Ibn Taymiyyah, may Allah have mercy upon him, said: "For this reason it was the case that all those that didn't worship Allah alone, it is a must that they are a worshippers of other than Him, worshipping other than Him, so being a Mushrik, and there's no third category in the children of Aadam, rather a person is either a Muwahid or a Mushrik, or those that mixed this with this, as the likes of that altered from the people of the religions: the Nasaarah, and those that resemble them from those that attribute to Islam". <Majmuu' Al-Fataawa> (14/282).

So whoever doesn't have the reality of Tawheed, then they are not Muslim even if they claimed attribution to Islam.

▪️Tawheed and Major Shirk are two opposites, they don't come together (3), if one of them is found the other is absent.

The Allaamah Abdurrahman bin Hassan, may Allah have mercy upon him, said: "For indeed whoever does Shirk, has left Tawheed, because they are two opposites and don't come together, so whenever Shirk is found Tawheed is absent". <Ad-Durar As-Saniyyah> (2/204).

So there isn't -in the legislation, or in existence, or in the correct intellect, or in the sound natural predisposition- a worshipper who is a Muwahid and at the same time a Mushrik with major Shirk!

The most high said:

(هُوَ ٱلَّذِى خَلَقَكُمْ فَمِنكُمْ كَافِرٌ وَمِنكُم مُّؤْمِنٌۚ)
"It is He who created you, and among you is the disbeliever, and among you is the believer".
[At-Taghabun:2]

And the most high said:

(فَمَاذَا بَعْدَ ٱلْحَقِّ إِلَّا ٱلضَّلَٰلُۖ)
"And what can be beyond truth except error?".
[Yunus:32]

And the Allaamah, Suleymaan bin Sahmaan, may Allah have mercy upon him, said: "Rather Islam and idolatry grave worship don't come together, except in the manner that in a heart of a believing slave can be belief that Muhammad is truthful and that Abu Jahl is truthful.

والله لن يجتمعا ولن يتلاقيا   ---  حتى تشيب مفارق الغربان
By Allah they won't come together and they won't meet   ---  Until white feathers on the middle of the crows head". End of speech from <Kashf Ghiyaab Adh-Dhalaam an Awhaam Jalaa Al-Afhaam> (p.93).

▪️The Tawheed Al-Uluuhiyyah which the one who deserves the title Islam and Tawheed with is:
Singling out Allah in the actions of the slaves, by humbling oneself to Him -alone and not anything besides Him- by doing His commands and abstaining from His prohibitions, out of love and veneration.

And whoever doesn't come with this isn't a Muslim nor a Muwahid.

▪️The Islam which is accepted with Allah, which a person deserves the title Islam and Tawheed through, is:
Submitting to Allah with Tawheed, and compliance to Him by being obedient, and freeing oneself from Shirk and its people. As stated by Imam An-Najdi -may Allah have mercy upon him- in "Thalaatha Al-Usuul", which is memorised by the young and old!

This means that:
A. Whoever worshipped other than Allah: Doesn't deserve the title Islam and Tawheed.
B. And that he who doesn't have compliance to Him by being obedient: Doesn't deserve the title Islam and Tawheed.
C. And that whoever doesn't free themselves from Shirk and its people: Doesn't deserve the title Islam and Tawheed.

Based upon the statement of the most high:

(فَمَن كَانَ يَرْجُوا۟ لِقَآءَ رَبِّهِۦ فَلْيَعْمَلْ عَمَلًا صَٰلِحًا وَلَا يُشْرِكْ بِعِبَادَةِ رَبِّهِۦٓ أَحَدًۢا)
"So whoever would hope for the meeting with his Lord -  let him do righteous work and not associate in the worship of his Lord anyone."
[Al-Kahf:110]

And His statement:

(فَمَن يَكْفُرْ بِٱلطَّٰغُوتِ وَيُؤْمِنۢ بِٱللَّهِ فَقَدِ ٱسْتَمْسَكَ بِٱلْعُرْوَةِ ٱلْوُثْقَىٰ)
"So whoever disbelieves in Taghut and believes in Allah has grasped the most trustworthy handhold with no break in it"
[Al-Baqarah:256]


▪️So whoever doesn't make worship solely to Him -exalted is He- and negate what the word Tawheed negates and affirm what it affirms, like it's the case with the grave worshippers who attribute to Islam, them saying: "Laa ilaha illallaah" doesn't benefit them.

Rather they -in reality- haven't pronounced it and haven't produced it, even if they might have uttered it, and they haven't come to know Islam, and haven't come to know from it what protects their blood and wealth, even if they might attribute themselves to it.

The Imam Suleiman bin Abdillah bin Muhammad bin Abdulwahaab, may Allah have mercy upon him, said in "Tayseer Al-Azeez Al-Hameed" (p.192): "So know that the scholars unanimously agreed upon that those that direct anything of the types of supplication to other than Allah, is a Mushrik, even if they might say "Laa ilaha illallaah wa Muhammadun Rasuululaah" and prayed and fasted, as the condition of Islam alongside pronouncing the two testifications is to not worship except Allah, so whoever comes with the two testifications and worshipped other than Allah, didn't come with it in reality, even if they uttered it, like the Yahuud those that say "Laa ilaha illallaah" (1) whilst they are Mushriks, and there's a consensus that merely uttering it doesn't suffice in Islam without acting upon what it means and believing it". End of speech.

The Allaamah Abdurrahman bin Hassan Aal Ash-Shaykh, may Allah have mercy upon him, said: "The most high said:

(شَهِدَ ٱللَّهُ أَنَّهُۥ لَآ إِلَٰهَ إِلَّا هُوَ وَٱلْمَلَٰٓئِكَةُ وَأُو۟لُوا۟ ٱلْعِلْمِ قَآئِمًۢا بِٱلْقِسْطِۚ لَآ إِلَٰهَ إِلَّا هُوَ ٱلْعَزِيزُ ٱلْحَكِيمُ)
"Allah witnesses that there is no deity except Him, and [so do] the angels and those of knowledge -  [that He is] maintaining [creation] in justice. None has the right to be worshipped but He, the Exalted in Might, the Wise".
[Aal-e-Imran:18]

So there remain not a deity worshipped which is worshipped by the early commers and the later besides Allah, except that their worship and them being a deification is nullified, by the witness of Allah and the angels and all those that have knowledge ...
And whoever doesn't believe that this is what Allah and His angels and his prophets bore witness to in their negation of this from these idols, and all what is worshipped besides Allah, then they haven't said "laa ilaha illallaah" (there is none worthy of worship in truth except Allah), and they haven't come to know the Islam which protects their blood and their wealth, and they become isolated from what Allah bore witness to". <Bayaan kalimah At-Tawheed war-rad alal Kashmeeri Abdulmahmuud> from amongst the <Majmuu'atur-Rasaail wal-Masaail An-Najdiyyah> (4/346).

And he, may Allah have mercy upon him, said: "What becomes imperative with "Laa ilaha illallaah" is being free from all that the Mushriks worship besides Allah, it is a must that all this is negated by freeing oneself from their worship and their worshippers, so whoever frees themselves from all of their worship and rebuke it and disbelief in it, then they have said "Laa ilaha illallaah" and have made worship solely for Allah, and with this Tawheed they have become Muslims believers". <Same as previous source> (1/344).
